Q.) Can you guarantee an eviction?

A.) We will guarantee that we will perform the eviction process efficiently and as quickly as possible. We never guarantee how a judge may rule his/her decision.

Q.) How fast can I get someone out?

A.) Generally, it takes 4-5 weeks from the time of filing the Summons of Complaint until lock-out if the complaint is uncontested. If it is contested it generally takes 5-6 weeks. The type of service and whether an answer is filed makes the difference. Additionally, waiting for a court date and Sheriff to set a lock-out date also contributes to the time factor.

Q.) Do I have to go to court?

A.) Either the owner or their agent may go with an attorney however, the owner must appear if they are without an attorney.

Q.) Can I turn off the water or electricity?

A.) No! That would be considered harassment and subject to a $100 a day fine.

Q.) Can a tenant withhold rent if repairs are not made?

A.) A tenant may withhold up to one month's rent, however, only after notice to landlord and a reasonable period of time to make repairs. The repairs must also be of a serious nature and directly related to a tenants health and safety and not caused by the tenant, their guests or pets.
